DVD Plaza Terms And Conditions

Use and membership of DVD Plaza is offered contingent upon your acceptance of the following terms and conditions. By using our web site you agree to be bound by the terms and conditions, as stated herein, and as may be modified from time to time (with or without notice to you), and warrant to DVD Plaza that you will not use DVD Plaza for any purpose that is unlawful or contravenes these terms and conditions.

Membership

At DVD Plaza we hold the utmost respect for your privacy. We require nothing more than a legitimate e-mail address as identification, and take extensive steps to protect this address. You may choose not to receive our monthly newsletter, which is sent monthly and full of the latest news and reviews. Your address is never published anywhere on DVD Plaza, and as per our Privacy Policy we comit our assurance that we will never disclose it in any fashion what-so-ever.

In exchange for the environment and facilities in which we provide, we require nothing more than for you to provide a legitimate e-mail address as proof of identification. Anonymous/free accounts such as hotmail are not acceptable, but rather the address supplied from your Internet Service Provider (ISP) or a corporate account. Membership will be suspended at the discretion of DVD Plaza unless our system can immediately reach you at the legitimate email address provided. Membership may also be terminated or suspended for inactivity. Should your email address change or cease to be operational, then the onus is upon you to notify DVD Plaza by way of amendment to your user profile.

The Discussion Café / Forums

In order to participate in our forums (herein called the Discussion Café) and other aspect of DVD Plaza, you are entitled to select a user name. You are also allocated a password, which may be changed, at your request. You are responsible for the confidentiality of your password, and you are responsible for all activity that occurs under your username. You agree to report to DVD Plaza any unauthorised usage of your user name and/or password.

Due to the real-time nature of the Discussion Café, it is impossible for us to review messages or confirm the validity of information posted. DVD Plaza has no obligation to monitor the Discussion Café or any user's use thereof, however reserves the right to do so. You cannot participate in the Discussion Café unless you agree to the following conditions:

Posts are to be made strictly within the correct forums. Off topic posts, or posts placed in the wrong forums will either be removed or relocated with or without notice.
Please avoid discussions on religion. This is a sensitive topic that is taken personally by some, and too delicate a matter to be discussed within the DVD Plaza Discussion Café. Discussion on such topics that relate directly to a movie and/or DVD title will be given exceptions at the discretion of DVD Plaza.
You must not restrict, inhibit, or otherwise interfere with the use or enjoyment of DVD Plaza of any member.
The posting of links to web or other internet content outside of DVD Plaza will be allowed at the discretion of DVD Plaza. For the purposes of these terms and conditions, content of sites linked by way of posting of URL addresses shall be treated as if the content of the linked site was posted directly to DVD Plaza. Accordingly, please consider these terms and conditions when posting links or other URLs including but not limited to considerations of profanity and infringement of copyright. The posting of referral and/or affiliate codes is strictly forbidden. This includes but is not limited to postings, signatures, profile options, and/or URLs that in turn link to pages that contain a referral/affiliate code, or other benefit bestowed upon the referrer, or other content determined in the absolute discretion of DVD Plaza to offend these terms and conditions. Discount schemes whereby you are rewarded, financial or otherwise, are also not permitted.
Posts containing any material which may be considered in the absolute discretion of DVD Plaza to be personal attacks, harassment of any kind, abusive or vulgar language, sexually oriented material, profanity, pornography, threats, invasion of privacy, racially or otherwise discriminatory, or anything that is otherwise violative of any law or civil right, or considered to infringe the rights and/or privacy of any other person, will not be tolerated. Such is expressed to include any conduct which encourages same. Any such matter which requires subjective assessment shall be determined by DVD Plaza in its absolute discretion, and no correspondence will be entered into concerning such assessment. Members involved in such activities will have their membership immediately revoked, and access to DVD Plaza barred, at the absolute discretion of DVD Plaza. DVD Plaza reserves the right to contact the Internet Service Provider of the user regarding such conduct. This term also applies to any postings which may be considered "retaliatory". Should you believe that a member has offended this or other terms and conditions, please click the "Report Post" button.
Fraudulent activities will not be tolerated. Do not use DVD Plaza in connection with chain letters, pyramid schemes, get rich quick schemes, how to "scam" companies, and/or any other scheme or project legal or otherwise. Do not use fraudulent names in the Discussion Café, have multiple accounts, and/or access the accounts of other users. Your membership may be immediately revoked, access to the site barred, your Internet Service Provider contacted, and your details provided to the companies in question, in the absolute discretion of DVD Plaza and in accordance with these terms and conditions.
DVD Plaza reserves the right to revoke membership for any or no reason, with or without warning.
DVD Plaza reserves the right to edit and/or remove postings to comply with these terms or for any other or no reason, with or without warning.
Online, retail, dealer, webmaster, and vendor participation is encouraged in the Discussion Café - we welcome your interaction with our members. You or any other member may not, however, use the Discussion Café to advertise, promote, or otherwise conduct business, services and/or activities/facilities including on other internet sites regardless of whether in competition with DVD Plaza, it's clients, or otherwise, without the express written permission of DVD Plaza. In the event that such written permission of DVD Plaza is not obtained, then DVD Plaza shall be entitled to render an invoice to you for advertising and promotion servces charged at commercial rates and terms (as determined in the absolute discretion of DVD Plaza). You are not permitted to harass/contact our members via e-mail, or otherwise collect information concerning members. This term applies to conduct which is commercial in nature or otherwise.
HTML JavaScript, Java applets, ActiveX, or any other web page content will not be accepted. Members are asked to use graphics sparingly due to performance concerns. Do not post any material of any kind which is calculated to injure, damage, impair or otherwise interfere with the software or hardware of DVD Plaza or any other user. Such conduct may result in the termination of your membership, and any other action that DVD Plaza considers necessary in its absolute discretion in accordance with these terms and conditions.
Postings made by members are the opinions of members and are the responsibility of the author. DVD Plaza assumes no responsibility for the content expressed and/or implied by members. Members are totally responsible for content they post on the Discussion Café, and DVD Plaza and/or its proprietor shall not be held liable. This includes opinions of moderators and reviewers, whether designated as "Staff" or otherwise, when not acting in their capacity as DVD Plaza Staff.

Please note that any right of action or otherwise reserved in favour of DVD Plaza in relation to the Discussion Café may also be exercised by any person appointed as "Moderator" by DVD Plaza from time to time. Such persons will be designated by the term "Moderator" (or by some other means of identification) in addition to their user name, and will be identifiable as such.

Trademark / Copyright Information

The DVD Plaza logo and PriceCrawler are both registered trademarks of DVD Plaza and protected under Australian and international laws.

All content without limitation, any information, text, reviews, articles, materials, graphics, software, advertisements, logos, icons, and images is the property of DVD Plaza, suppliers, vendors, and/or licensors unless expressly indicated otherwise. Such content is protected by Australian and international copyright and trademark laws. You are not permitted to modify, copy, reproduce, republish, frame, upload, post, transmit or distribute such content in any way unless expressly authorised in writing by DVD Plaza. Such content may be downloaded and viewed for personal non-commercial use only.

By posting information or messages to the Discussion Café, or any other area of the site, you grant DVD Plaza an unrestricted license to publish, reproduce, broadcast or transmit such information, and you waive any copyright or other intellectual property rights you may have to those messages or information.

By posting any information or messages to the Discussion Café, you expressly warrant to DVD Plaza you do not contravene any intellectual property rights or copyright entitlements attached to such information, and you expressly agree to indemnify DVD Plaza in relation to any claims relating to infringement of such rights.

Limitation Of Liability

DVD Plaza encourages contact between members, however does not sponsor, endorse or otherwise take responsibility for events, gatherings, functions, meetings or other forms of contact whether organised by reference to the site or elsewhere unless specifically stated by DVD Plaza.

Neither DVD Plaza nor it's proprietor and/or any other party affiliated with or designated as "Staff" by DVD Plaza, is liable for any direct, indirect, incidental, consequential or punitive damages arising out of your use or accessing of the DVD Plaza, or inability to so access or use DVD Plaza. DVD Plaza is provided to you "AS IS" and without warranty of any kind whether expressed or implied.

Under no circumstances will DVD Plaza and/or it's proprietor be held liable for any damages and/or losses whatsoever whether direct, indirect, punitive, special, or consequential damages or loss of profits that are directly or indirectly related to the use of, or the inability to use, DVD Plaza and/or any third party services/offers, even if advised of the possibility of such damages or that such damages were foreseeable to DVD Plaza. DVD Plaza gives no warranty as to its availability, accessibility or function.

DVD Plaza does not tolerate fraud and will endeavour to protect those who deal with us. It is a violation of the law to make orders under a false name, an invalid credit card, or under multiple accounts to abuse exclusive or non-exclusive offers. Any knowledge of fraud will be immediately passed onto the applicable third parties and your participation on DVD Plaza may be barred.

Third Party Vendors And Service Providers

DVD Plaza actively promotes and advertises products, services, specials, and exclusive deals. DVD Plaza also contains banners and embedded and non-embedded links and referrals to other web sites and/or enterprises operated by third parties and/or their contractors/licensees. These linked sites are by no means under the control of DVD Plaza and as such DVD Plaza cannot be responsible for the contents of such sites. Licence to use the PriceCrawler® is provided free of charge for personal, domestic and non-commercial uses. Any other use of the PriceCrawler®, including use for commercial or other means for profit, is strictly prohibited without the express written consent of DVD Plaza. DVD Plaza specifically reserves the author's intellectual property rights with respect to the design, operation, and output of the PriceCrawler® as conferred by the Copyright Act, 1968.

Indemnity

By accepting these terms and conditions, you agree to indemnify DVD Plaza in respect of any claim or demand made by any person arising out of your use of DVD Plaza. Such indemnity includes the reasonable legal fees of DVD Plaza.

Reservation of Rights

DVD Plaza reserves the right to add to, change, or remove conditions of use and membership at any time for any reason, with or without notice to you. You agree to abide by the conditions of use and membership as they stand at any point in time, and accordingly, please review these terms and conditions from time to time, as any use of DVD Plaza after a change to the terms and conditions will constitute acceptance by you of the amended terms and conditions.

All rights not expressly granted in these Terms are reserved. These terms are governed by the laws of South Australia. Such terms are severable, and the unenforceability of any term shall not invalidate the remainder of this agreement.
